Sounds like Odahviing is currently marked as an essential character, so you won't be allowed to kill him until that changes. I had the same problem when trying to choose between Paarthurnax & the blades. Tried to kill Esbern & Delphine, but they'd only drop to 1 HP. I even led Delphine to a ledge & shouted her off a mountain.
